Terms of Service

These terms are an agreement between you and Ukung LLC, a Washington limited liability company ("Ukung", "we", "us"). They govern your use of ukung.com, our apps and our command-line tool. By creating an account or using the service, you agree to them. If you don't agree, please don't use Ukung.

1. The service

Ukung lets you upload geotagged photos and videos that appear on a private world map and timeline, organize them into trips, and optionally share them with people you choose. We may add, change, or remove features over time.

2. Your account

You sign in through a third-party provider (Microsoft, Google, Facebook, or email). You are responsible for keeping access to that account secure and for activity that happens under your Ukung account, including through API tokens you create. You must be old enough to form a binding contract where you live, and at least 13 (or the minimum age of digital consent in your country, where higher). Don't create another account to get around a suspension or a block.

3. Your content stays yours

You keep all rights to the photos, videos, comments and other content you upload. You grant Ukung only the limited, worldwide, non-exclusive, royalty-free licence needed to operate the service for you: to store, copy, process, tile, display and (where you choose to share) distribute your content to the people you share it with. The licence ends when you delete the content or your account, apart from backup copies that expire on our normal cycle and anything the law requires us to keep. We do not claim ownership of your content, we do not sell it, and we do not use it for advertising.

You promise that you have the rights needed to upload and share what you put on Ukung. That includes the permission of anyone who can be clearly identified in content you share publicly.

The Community Guidelines explain in plain language what is and isn't allowed, and form part of these terms. In short, you agree not to use Ukung to:

5. Shared and private content

Your content is private by default. When you share a trip, publish a collection, post a comment or create a public link, you are choosing to make that content visible to other people — and, for a public link, to anyone who has it. You are responsible for what you choose to share.

Shared content and comments must follow every rule in section 4. Private content that only you can see must still be lawful. It must never include material that sexualizes minors, or intimate images of someone taken or kept without their consent. Beyond that, what you keep privately is your business: we don't look for or act on lawful adult content that you never share.

6. How we enforce these terms

Anyone, signed in or not, can report shared content or a comment using its Report control, or by emailing hello@ukung.com. A person reviews each report. We don't remove content automatically because of how many reports it gets.

To keep the service safe, we may use automated tools, such as matching uploads against databases of known child sexual abuse material and checking content when it is shared publicly. These tools can hold back sharing until a person has reviewed it. They are not used for advertising or to rank what you see.

If content breaks these terms, we may, depending on how serious it is:

Unless the law or someone's safety stops us, we will tell you what we did and why. If you think we got it wrong, reply to that notice or email hello@ukung.com and a person will look again. We aren't obliged to monitor content, and we may decline to act on a report.

7. Copyright complaints

If you believe content on Ukung infringes your copyright, send a notice to our designated copyright agent at hello@ukung.com with the subject "Copyright notice", or by post to Ukung LLC, Attn: Copyright Agent, 522 W Riverside Ave, Ste N, Spokane, WA 99201-0581, United States. Include:

If your content was removed and you believe that was a mistake, you can send a counter-notice to the same address, as described in the U.S. Digital Millennium Copyright Act. We close the accounts of repeat infringers.

8. Ukung Premium

Some features are part of Ukung Premium, a paid subscription.

9. Privacy

Our Privacy Policy explains what we collect and how we handle it, and forms part of these terms.

10. Availability

We work to keep Ukung running, but the service is provided "as is" and "as available," without warranties of any kind, to the extent the law allows. We don't guarantee it will be uninterrupted or error-free, and we may suspend or discontinue features or the service itself. If we ever shut Ukung down, we will give you reasonable notice and a way to download your photos and videos first.

11. Limitation of liability

To the fullest extent permitted by law, Ukung LLC is not liable for indirect, incidental, special or consequential damages, or for loss of data or content. Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the 12 months before the claim, or US$50. Keep your own copies of anything important — Ukung is a place to enjoy your memories, not a guaranteed sole backup of them. Some places don't allow these limits, so they may not all apply to you.

12. Indemnity

If someone brings a claim against Ukung because of content you uploaded or shared, or because you broke these terms, you agree to cover the reasonable costs of that claim, to the extent the law allows.

13. Ending the agreement

You may stop using Ukung and delete your account at any time. We may suspend or close your account under section 6. When an account closes, sections 7, 11, 12 and 14 continue to apply.

14. Governing law and disputes

These terms are governed by the laws of the State of Washington, USA, apart from its conflict-of-laws rules. Please email us first; most problems can be solved that way. Any dispute that can't be solved must be brought in the state or federal courts located in King County, Washington, and you and we consent to their jurisdiction. Either of us may instead bring a claim in small-claims court where it qualifies. If the law of your country gives you the right to bring a claim in your own courts, nothing here takes that right away.

15. Changes to these terms

We may update these terms as the service evolves. When we make material changes we will update the date above and, where appropriate, notify you. Continuing to use Ukung after changes take effect means you accept the updated terms.

16. General

If any part of these terms can't be enforced, the rest still applies. If we don't enforce a term, we haven't waived it. You can't transfer these terms to someone else. We may transfer them to a company that takes over Ukung, which will then be bound by them. These terms, the Community Guidelines and the Privacy Policy are the whole agreement between us about the service.
